CastaldiPartners obtains an important ruling before the French Supreme Court

Camille Gibert, Edouard Billemaz and Sara Venturini of CastaldiPartners have obtained an important ruling before the French Supreme Court, which settles for the first time the question of the implementation of a first-demand bank guarantee for non-payment of rent during the "protected period" of the health crisis.

Pursuant to article 14 of law no. 2020-1379 of November 14, 2020, the French Supreme Court ruled that the bank guarantee could not be used against eligible tenants during the "protected period", holding that payment by the bank in favor of the landlord would constitute a manifestly unlawful disturbance.
